Sept. 17, 2015, Fairfax, Va.–Americans for Limited Government President Rick Manning today issued the following statement blasting Senate inaction to consider the Iran nuclear deal as a treaty under Article II of the Constitution:
“President Obama’s Iran deal is scheduled to go into effect today in spite of his failure to follow the terms of Corker-Cardin, which required full submission of the agreement to Congress, including any side deals. However, more concerning is that the government has unilaterally amended Nuclear Non-Proliferation Treaty obligations, violating the treaty clause of the U.S. Constitution since no treaty can be amended by statute or without full ratification of the Senate.
“The responsibility and duty of the Senate is to bring up Obama’s Iran nuclear deal as a treaty immediately and defeat it. By forcing Obama’s treaty into the normal ratification process, the Senate will set up a court fight over whether the President can unilaterally change a treaty. While such a court fight may not stop certain aspects of the deal from going forward, it can have the effect of stopping the transfer of billions of dollars to an Islamofascist Iranian regime. And that is a fight worth having.”
