Aug. 12, 2022, Fairfax, Va.—Americans for Limited Government President Rick Manning today issued the following statement reacting to former President Donald Trump’s Aug. 12 statement on Truth Social that “it was all declassified” referring to document seized from his Palm Beach, Fla. residence, Mar-a-Lago on Aug. by the FBI:
“The vesting clause of Article II, Section 1 of the Constitution grants all executive power to the President, including declassification of any executive branch documents by former President Donald Trump while he was still in office. Any attempt by President Joe Biden’s Department of Justice to ignore this settled principle of constitutional law is just another example of the left’s ongoing harassment of Trump and should be treated with scorn and derision.”

His authority to classify and control access to information bearing on national security and to determine whether an individual is sufficiently trustworthy to occupy a position in the Executive Branch that will give that person access to such information flows primarily from this constitutional investment of power in the President and exists quite apart from any explicit congressional grant.” Department of Navy v.
